1. Application and Precedence These Terms and Conditions govern all purchases of products (“Products”) from leveltshirts.co.uk (the “Seller” or “we/us”). By placing an order, you (the “Customer” or “you”) agree to be bound by these terms exclusively. Any additional, different, or conflicting terms proposed by you are expressly rejected. Our acceptance of your order is limited to these terms only.
2. Pricing: All prices are in British Pounds (GBP) and exclusive of delivery/shipping costs, VAT (where applicable), and any other taxes or duties, unless clearly stated otherwise on the website or order confirmation.
3. Payment: Payment is required in full before we process or ship your order, unless we have agreed alternative payment terms in writing. All payments must be made in GBP.
4. Taxes and Duties: Our prices do not include VAT, customs duties, import taxes, or any other government-imposed charges. You are responsible for paying all such amounts. If you are outside the UK, you may also be responsible for any local import fees or customs clearance costs.
5. Delivery, Shipping, and Risk
- Title (ownership) to the Products passes to you upon delivery to the carrier at our shipping point.
- Risk of loss or damage passes to you at the point of shipment.
- We may arrange shipping and insurance on your behalf, but all related charges will be added to your invoice and payable by you.
- Delivery times are estimates only. We are not liable for delays caused by events beyond our reasonable control (see Force Majeure below).
6. Inspection and Acceptance You must inspect the Products promptly upon receipt. Any claims for shortages, damage, defects, or non-conformity must be notified to us in writing within 3 working days of delivery. If no written notice is received within this period, you will be deemed to have accepted the Products fully and waived any right to claim based on issues that should have been apparent on reasonable inspection. Use or installation of the Products constitutes acceptance.
7. Returns and Refunds Our returns policy is separate (see Return & Refund Policy page). These terms do not override statutory UK consumer rights where applicable.
8. Limitation of Liability To the fullest extent permitted by law:
- We shall not be liable for any loss of profit, revenue, business opportunity, or any indirect, special, consequential, or incidental damages, whether arising in contract, tort (including negligence), strict liability, or otherwise — even if we were advised of the possibility of such losses.
- Our total liability for any claim relating to a specific Product shall not exceed the price paid by you for that Product. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.
9. Force Majeure Neither party shall be liable for any delay or failure to perform (except payment obligations) due to causes beyond its reasonable control, including (but not limited to) strikes, lockouts, riots, war, terrorism, fire, flood, natural disasters, pandemics, government actions, or supply chain disruptions. The affected party will resume performance as soon as reasonably possible.
10. Entire Agreement These terms (together with your order confirmation, our website policies, and any referenced documents) constitute the entire agreement between us and supersede all prior discussions, representations, or understandings. No changes are valid unless agreed in writing and signed by both parties.
11. Assignment You may not assign, transfer, or subcontract your rights or obligations under these terms without our prior written consent.
12. Severability If any provision is found invalid or unenforceable, the remaining provisions remain in full force. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
13. No Waiver Our failure to enforce any right or provision at any time does not constitute a waiver of that right or provision.
14. Governing Law and Dispute Resolution These terms are governed by the laws of England and Wales. Any disputes arising out of or in connection with these terms or your purchase shall be subject to the exclusive jurisdiction of the courts of England and Wales. (Alternative: We may agree to arbitration or mediation in appropriate cases, but this is not mandatory.)
15. Export and Compliance You agree to comply with all applicable export control laws and regulations. You will not export or re-export Products in violation of such laws.
16. Notices Any formal notices must be in writing and sent to our registered/contact address (as listed on our website or order documents).
